Terms and Conditions of Use Agreement

PLEASE READ THE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS SITE. We maintain this web site as a service to our customers, and by using our site you are agreeing to comply with and be bound by the following terms of use. Please review the following terms and conditions carefully, and check them periodically for changes. If you do not agree to the terms and conditions, you should not review information or obtain goods, services or products from this site.

  1.      Acceptance of Agreement. You agree to the terms and conditions outlined in this Terms and Conditions of use Agreement with respect to our site (SDKnives). This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended by us at any time and from time to time without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site.
  2.      Copyright. The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks, registered trademarks and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such matters or any part of the Site, except as allowed by Section 4, is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through the Site. The posting of information or materials on the Site does not constitute a waiver of any right in such information and materials.
  3.      Fraud: By becoming a member, you confirm that the information provided in this form is true and that you agree to abide by the Terms and Conditions of use of this site. Please note that your membership can be cancelled without notice if it is determined that false or misleading information has been provided, the Terms and Conditions of use have been violated, or other abuses have occurred as determined by SDKnives. in its sole discretion. If membership has been revoked, SDKnives reserves the right to refuse application or readmission.
  4.      Limited Right to Use. The viewing, printing or downloading of any content, graphic, form or document from the Site grants you only a limited, non-exclusive license for use solely by you for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works or other use. No part of any content, form or document may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical, other than for your personal use (but not for resale or redistribution).
  5.      Editing, Deleting and Modification. We reserve the right in our sole discretion to edit or delete any documents, information or other content appearing on the Site, including this Agreement, without further notice to users of the Site.
  6.      Indemnification. You agree to indemnify, defend and hold us and our partners, attorneys, staff and affiliates (collectively, “Affiliated Parties”) harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, related to your violation of this Agreement or use of the Site.
  7.      Nontransferable. Your right to use the Site is not transferable. Any password or right given to you to obtain information or documents is not transferable and may only be used by you.
  8.      Disclaimer. THE INFORMATION FROM OR THROUGH THE SITE ARE PROVIDED “AS-IS,” “AS AVAILABLE,” AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO THE DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE). THE INFORMATION AND SERVICES MAY CONTAIN BUGS, ERRORS, PROBLEMS OR OTHER LIMITATIONS. WE AND OUR AFFILIATED PARTIES HAVE NO LIABILITY WHATSOEVER FOR YOUR USE OF ANY INFORMATION OR SERVICE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US THROUGH THE SITE SHALL CREATE ANY WARRANTY, REPRESENTATION OR GUARANTEE NOT EXPRESSLY STATED IN THIS AGREEMENT.
  9.         Limits. All responsibility or liability for any damages caused by viruses contained within the electronic file containing the form or document is disclaimed. WE WILL NOT BE LIABLE TO YOU FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND THAT MAY RESULT FROM USE OF OR INABILITY TO USE OUR SITE. Our maximum liability to you under all circumstances will be equal to the purchase price you pay for any goods, services or information.
  10. Use of Information. We reserve the right, and you authorize us, to the use and assignment of all information regarding Site uses by you and all information provided by you in any manner consistent with our Privacy Policy.
  1. Third-Party Services. We allow access to or advertise third-party merchant sites (“Merchants”) from which you may purchase or otherwise obtain certain goods or services. You understand that we do not operate or control the products or services offered by such Merchants. Merchants are responsible for all aspects of order processing, fulfilment, billing and customer service. We are not a party to the transactions entered into between you and Merchants. YOU AGREE THAT USE OF SUCH MERCHANTS IS AT YOUR SOLE RISK AND IS WITHOUT WARRANTIES OF ANY KIND BY US, EXPRESSED, IMPLIED OR OTHERWISE INCLUDING WARRANTIES OF TITLE, FITNESS FOR PURPOSE, MERCHANTABILITY OR NON-INFRINGEMENT UNDER NO CIRCUMSTANCES ARE WE LIABLE FOR ANY DAMAGES ARISING FROM THE TRANSACTIONS BETWEEN YOU AND MERCHANTS OR FOR ANY INFORMATION APPEARING ON MERCHANT SITES OR ANY OTHER SITE LINKED TO OUR SITE.
  2. Third-Party Merchant Policies. All rules, policies (including privacy policies) and operating procedures of Merchants will apply to you while on such sites. We are not responsible for information provided by you to such Merchants. We and the Merchants are independent contractors and neither party has authority to make any representations or commitments on behalf of the other.
  3. Payments. You represent and warrant that if you are purchasing something from us or from our Merchants that (i) any credit card information you supply is true, correct and complete, (i) charges incurred by you will be honoured by your credit card company, and (iii) you will pay the charges incurred by you at the posted prices, including any shipping fees and applicable taxes.
  4. Securities Laws. This Site may include statements concerning our operations, prospects, strategies, financial condition, future economic performance and demand for our products or services, as well as our intentions, plans and objectives, that are forward-looking statements. These statements are based upon a number of assumptions and estimates which are subject to significant uncertainties, many of which are beyond our control. We are not responsible for the content, accuracy or opinions express in such Web sites, and such Web sites are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked Web site on our Site does not imply approval or endorsement of the linked Web site by us. If you decide to leave our Site and access these third-party sites, you do so at your own risk.
  6. Submissions. All suggestions, ideas, notes, concepts and other information you may from time to time send to us (collectively, “Submissions”) shall be deemed and shall remain our sole property and shall not be subject to any obligation of confidence on our part. Without limiting the foregoing, we shall be deemed to own all known and hereafter existing rights of every kind and nature regarding the Submissions and shall be entitled to unrestricted use of the Submissions for any purpose, without compensation to the provider of the Submissions.

Return Policy

Due to the nature of our online site, and the products listed, we SDKnives will accept the return of product(s) if and only if the following steps outlined below are abided by:

  1. If you are not satisfied with your merchandise you can return it for a full refund. You will have to pay for shipping for returning the merchandise and will not be refunded for the original shipping cost to you. If the merchandise is not in the same condition as when it was sent we cannot accept it back and you will have to pay for shipping back to you or we will keep it. No credit or returns will be issued on Custom orders and there are no cancellations or changes allowed. If an item is damaged or used it is considered accepted and can’t be returned or exchanged for any reasons. Any and all claims must be made with-in 72 hours of receipt.
  2. Obtain a Return Authorization Number (RA#) within 72 hours of delivery date by calling (082-5787440).
  3. Please provide the following information when requesting a RA#: Original order number, name of product requesting return, reason for return, your name, daytime telephone number and email address.
  4. Verify that all the merchandise is in the original packaging and in tact, and that all accessories are included.
  5. For your protection, please insure the package and use a “traceable” shipping method. You are responsible to ensuring that the items get to us in their original condition.
  6. Please provide the RA# both on the inside and outside of your package and return to the address below. Please note that items that do not have a return authorization number will be refused and returned to the sender.

  8. Return the merchandise within 5 days of the issuance of the RA#.

Returns and Cancelations

Where you have used a Fixed Coupon to pay for an order, and you or SD Knives and Supplies later cancels your order (or part thereof) prior to delivery of the relevant product(s), or you log a return of one or more products for a credit in accordance with the Returns Policy, the value of the Fixed Coupon will be deducted off the purchase price of the cancelled or returned product(s) (as applicable), and we will credit your account for the balance, if any (or refund you if that is your preference). We will also provide you with a replacement Fixed Coupon of the same value as the original Fixed Coupon used. SD Knives and Supplies may in its sole discretion impose restrictions on the use of the replacement Fixed Coupon.  For any subsequent cancellations or returns arising out of the same order, we will credit your account as normal with the value of the returned product (or refund you if that is your preference).

Where you have used a Percentage Coupon  to pay for an order, and you or SD Knives and Supplies later cancels your order (or part thereof) prior to delivery of the relevant product(s), or you log a return of one or more products for a credit in accordance with the Returns Policy, the value of the discount received using the Percentage Coupon will be deducted off the purchase price of the cancelled or returned product(s) (as applicable), and we will credit your account for the balance, if any (or refund you if that is your preference). We will also provide you with a replacement Fixed Coupon of the same value as the discount received using the original Percentage Coupon. SD Knives and Supplies may in its sole discretion impose restrictions on the use of the replacement Fixed Coupon. For any subsequent cancellations or returns arising out of the same order, we will credit your account as normal with the value of the returned product (or refund you if that is your preference).

Wherever you have used a Gift Voucher to purchase a product that you later return for a refund in accordance with the Policy, we cannot refund you in cash for that portion of the purchase price which you paid using the Gift Voucher, but we will credit your account.

Credits

  1. Credit will be issued after our warehouse receives, inspects, and processes your return: however, your credit card company determines when the issued credit will be reflected in your statement. Please allow one to two billing cycles. All returns for credit must be received with a valid Return Authorization (RA#) Number.
  2. Verify Clients’ Address: SDKnives reserves the right to contact a Member via email to verify the accuracy of account information (including the Member’s correct name and address) that is needed to provide the Member with the information he or she requested from SDKnives.

Gift Vouchers

SD Knives and Supplies Gift Vouchers are not redeemable for cash and will not be replaced if lost, stolen, destroyed or used without permission. SD Knives and Supplies Vouchers cannot be resold to- or exchanged with a third party. You cannot use an SD Knives and Supplies Gift Voucher to purchase another SD Knives and Supplies Gift Voucher. SD Knives and Supplies Gift Vouchers can only be redeemed online through our website (www.sdknives.co.za) or in-store.

SD Knives and Supplies may from time to time make physical or electronic gift vouchers (“Gift Vouchers”) and promotional coupons or discounts (“Coupons”) available for use on the Website towards the purchase of SD Knives and Supplies products. Gift Vouchers and Coupons can only be redeemed while they are valid and their expiry dates cannot be extended. More specifically:

  1. Gift Vouchers that are purchased by registered users are valid for 3 years after Sale. Gift Vouchers that SD Knives and Supplies give away for free are valid for the period stated thereon. In each case, if your Gift Voucher has not been used within that period, it will expire.
  2. Gift Vouchers cannot be used to buy other Gift Vouchers or used with Coupons. They do not accrue interest and are not refundable for cash once purchased or otherwise obtained. If your Gift Voucher value is less than the amount required to cover the full order you wish to place, you may make up the difference by paying via one of our other payment methods.
  3. SD Knives and Supplies is not responsible for any harm due to the loss, unauthorised use or unauthorised distribution of a Gift Voucher, after SD Knives and Supplies has delivered the Gift Voucher to you, or the email address nominated by you.

Coupons

  1. There are two types of Coupons: a Coupon with a fixed amount of a discount, e.g. R100 off (“FixedCoupon“), and a Coupon with a percentage discount, e.g. 10% off (“Percentage Coupon“).
  2. Coupons are issued in SD Knives and Supplies’ sole discretion and we are entitled at any time to correct, cancel or reject a Coupon for any reason (including without limitation where a Coupon has been distributed in an unauthorised manner). Users do not have a right to Coupons, and Coupons cannot be earned. Coupons are issued under specific terms and conditions regulating when and how they may be used.
  3. As a general rule, and unless specified otherwise on the specific Coupon itself:
    • each Coupon can only be used once;
    • only one Coupon can be used per order;
    • only one Coupon can be used on the website per person per promotion/campaign;
    • Percentage Coupons may only be used on purchases with a total cart value of less than R5,000;
    • where a Percentage Coupon has been used and you wish to cancel any items in the order prior to making payment, the entire order must be cancelled. You will be issued with a new Percentage Coupon and will need to place the order again, without the items that you wished to cancel;
    • a Coupon must be used at check-out – it cannot be used in retrospect to existing orders; and
    • the value of the Coupon will be set off against the value of your shopping basket and the balance remaining, if any, will be payable by you.
  4. Coupons cannot be used to buy Gift Voucher or other Coupons, and cannot be exchanged or refunded for cash or credit. SD Knives and Supplies is not responsible for any harm due to the loss, unauthorised use or distribution of a Coupon.
  5. If for any reason a Coupon does not reflect in the final amount due from you at check-out,  please get in touch with us via our Contact Us page, to confirm if the Coupon is still valid. If SD Knives and Supplies confirms that the Coupon is still valid and you have already placed your order, you can choose whether to cancel the order and place it again with the Coupon, or you can use the Coupon on your next order within the limitations of the specific Coupon’s terms and conditions.
  6. You may be required to submit the original communication containing the Coupon code, and any other information reasonably requested by SD Knives and Supplies, before you are able to use a Coupon.
